3. General notes and mandatory information

Privacy policy

The operator of this website takes the protection of your personal data very seriously. We therefore treat your personal data as confidential information and in compliance with statutory data protection regulations and this privacy declaration.

We collect various types of personal data when you visit this website. The term ‘personal data’ refers to all data that can be used to personally identify you. This privacy declaration explains which data we collect and what we use it for. It also explains how it is done and the purposes for which it is used.

Nevertheless, we must call your attention to the fact that the communication of such data via Internet (e.g. by e-mail) may not be absolutely secure. Absolute protection of your data against unauthorized or illegal, third party access cannot be guaranteed.

Information about the responsible party (referred to as the ‘controller’ in the GDPR)

The data processing controller on this website is:

Berlin Millhouse GmbH
Markscheiderstraße 44
13047 Berlin, Germany

Phone: +49-30-41-47-94-0
E-Mail: info@berlin-millhouse.de

The controller is the natural person or legal entity that single-handedly or jointly with others makes decisions as to the purposes of and resources for the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage period

Unless a more specific storage period has been specified within this data protection declaration, your personal data will remain with us until the purpose for which it was collected ceases to apply. Should you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, the deletion will take place after these reasons have ceased to apply.

Note on the transfer of data to the USA

Among other things, our website contains tools from companies located in the USA. When these tools are active, your personal data may be transferred to the US servers of the respective companies. We would like to point out that the USA is not a safe third country in terms of EU data protection law. US companies are obliged to release personal data to security authorities without you as the person concerned being able to take legal action against this. It cannot, therefore, be ruled out that US authorities (e.g. secret services) may process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to the processing of your data

Many data processing operations are only possible with your express consent. You may revoke your previously given consent at any time. The lawfulness of data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and direct mail (Article 21 GDPR)

YOU HAVE THE RIGHT TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA WHICH IS BASED ON ARTICLE 6 SECT. 1 LIT. E OR F GDPR, INCLUDING PROFILING BASED ON THOSE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY DECLARATION. SHOULD YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR FOR THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS. (OBJECTION ACCORDING TO ART. 21 SECT. 1 GDPR).

IF YOUR PERSONAL DATA ARE PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING, WHICH INCLUDES PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. SHOULD YOU OBJECT TO PROCESSING FOR DIRECT MARKETING PURPOSES, THE PERSONAL DATA SHALL NO LONGER BE PROCESSED FOR SUCH PURPOSES. (OBJECTION UNDER ART. 21 SECT. 2 GDPR).

Right to lodge a complaint with a competent supervisory authority

In the event of infringements of data protection legislation (GDPR), the person affected may lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work, or the place of the alleged infringement without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfill a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

For security reasons and to protect the transmission of confidential content, such as purchase orders or inquiries you submit to us as the website operator, this website uses either an SSL or a TLS encryption program. You can recognize an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and a padlock icon displayed in the address bar.

When SSL or TLS encryption is activated, data you transmit to us cannot be read by third parties.

Information, deletion, and rectification

Within the scope of applicable statutory provisions, you have the right to demand information about your personal data we have stored, its origin and recipients and the purpose served by processing the data, and if applicable, a right to rectification or deletion of such data, at any time and free of charge. You can contact us on this matter and on any further questions you may have about on the topic of personal data at any time at the address given in the ‘LEGAL NOTICE’ section.

Right to demand restriction of processing

You have the right to demand that the processing of your personal data be restricted. Please do not hesitate to contact us at any time at the contact address indicated in the ‘LEGAL NOTICE’ section on this website if you require further information. The right to restriction of processing exists in the following cases:

  • In the event that you should dispute the correctness of your data stored by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
  • If the processing of your personal data has been/is being conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding its deletion.
  • Should we no longer need your personal data, and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its deletion.
  • Should you have filed an objection pursuant to Art. 21 Sect. 1 GDPR, your and our respective interests will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

4. The collection of data on this website

Cookies

Our website uses so-called “Cookies”. Cookies are small text files that do not damage your end-device in any way. They are either temporarily placed for the duration of your visit (session cookies), or permanently stored on your end-device (permanent cookies). Session cookies are automatically deleted the moment you leave our website. Permanent cookies remain on your end-device until you delete them or until they are automatically deleted by your web browser.

In some cases, cookies from third parties may be stored on your end-device when you visit their websites (third party cookies). These enable us or you to make use of certain services offered by third parties (e.g. cookies for the processing of payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies are used to evaluate user behavior or display advertising.

Cookies that are required to carry out the electronic communication process (necessary cookies) or to provide certain functions that you have requested (functional cookies, e.g. for the shopping basket function) or to optimize the website (e.g. cookies for measuring the web audience) are stored on the basis of Art. 6 Sect. 1 lit. f GDPR, unless another legal basis is given. The website operator has a legitimate interest in the storage of cookies to ensure the provision of an optimized service free of technical errors. Provided that consent to the storage of cookies has been requested, the storage of the cookies in question will be carried out exclusively on the basis of this consent (Art. 6 Sect. 1 lit. a GDPR); the consent can be revoked at any time.

You can also set your browser to provide notification when a website attempts to install a cookie, permit the installation of cookies only in individual cases, generally forbid the installation of cookies and activate automatic deletion of cookies when you close your browser. However, the deactivation of cookies may have adverse effects on the functionalities of this website.

Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you separately about this within the scope of this data protection declaration and, if necessary, request your consent.

5. Plug-ins and tools

YouTube with extended data protection integration

This website integrates videos of the YouTube platform, which is operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in an extended data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Nonetheless, it does not necessarily rule out the sharing of data with YouTube partners. For example, YouTube will establish a connection with the Google DoubleClick network, regardless of whether you watch a video.

As soon as you start to play a YouTube video on our website, a connection to the YouTube servers is established. The YouTube server will be notified, which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to directly assign your browsing behavior to your personal profile. This can be prevented by logging out of your YouTube account.

Moreover, after you have started to play a video, YouTube can place various cookies or comparable identification technologies on your device (e.g. device fingerprinting). These cookies enable YouTube to collect information about website visitors. The information collected will be used, amongst other things, to generate video statistics, improve the user-friendliness, and prevent fraud attempts.

Additional data processing operations which are beyond our control may be activated after you have started to play a YouTube video.

The use of YouTube represents a legitimate interest in the appealing presentation of our online content (pursuant to Art. 6 Sect. 1 lit f GDPR). Provided that relevant consent has been requested, the processing is performed pursuant to Art. 6 Sect. 1 lit. a GDPR; this consent can be withdrawn at any time.

Please consult the YouTube Data Privacy Policy to find out more about how YouTube handles data protection:  https://policies.google.com/privacy?hl=de.

Google Web Fonts (local hosting)

For the purpose of a uniform presentation of fonts, this website uses so called Web Fonts provided by Google. The Google Fonts are installed locally. A connection to Google’s servers does not take place.

Further information about Google Web Fonts can be found at https://developers.google.com/fonts/faq  and in the Google Data Privacy Policy at: https://policies.google.com/privacy?hl=de.

OpenStreetMap

We use the map service from OpenStreetMap (OSM). This service is provided by the OpenStreetMap Foundation (OSMF), 132 Maney Hill Road, Sutton Coldfield, West Midlands, B72 1JU, United Kingdom.

When you visit a website in which OpenStreetMap is integrated, information such as your IP address and other information about your behavior on that website is forwarded to OSMF. OpenStreetMap may store cookies in your browser for this purpose or utilize comparable identification technologies.

Furthermore, your location can also be registered if you have consented to this in your device settings, e.g. on your cell phone. The provider of this website has no influence on the transmission of this data. Details can be found in the data protection declaration of OpenStreetMap under the following link: https://wiki.osmfoundation.org/wiki/Privacy_Policy.

OpenStreetMap is used to ensure the attractive presentation of our online content and for making the places indicated on our website easier to find. This represents a legitimate interest in the sense of Art. 6 Sect. 1 lit. f GDPR. Provided that a relevant consent has been requested (e.g. consent to the storage of cookies), the processing is performed pursuant to Art. 6 Sect. 1 lit. a GDPR; this consent can be withdrawn at any time.
